Levelingo Terms of Service & End User License Agreement

1. Accounts, Eligibility & Scope of License

To use Levelingo, you must create an account using a valid email and password. You must be at least 9 years old. You are responsible for maintaining the security of your account.

The license granted to you for Levelingo is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Accounts may be terminated for violation of these Terms, including:

• Using bots, scripts, or automated systems to farm XP or bypass human interaction
• Exploiting the app to unlock paid features without a subscription
• Repeatedly calling our APIs in a way that strains or abuses the system
• Attempting to hack or disrupt our infrastructure
• Generating offensive, harmful, or inappropriate flashcard content

2. Content & Intellectual Property Rights

All content in the app — including flashcards, AI-generated lessons, artwork, and user-generated content — is the property of Levelingo LLC. You are allowed to share or reuse content you create in the app, as long as it is not scraped or redistributed at scale.

You do not own any of the generated content, even if it was customized by your inputs.

In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Levelingo LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

3. Subscription Terms & Warranty

Levelingo offers premium content via auto-renewing subscriptions handled through the Apple App Store. All billing and subscription management is handled through your Apple ID.

• No traditional free trial is provided.
• Users are limited to certain features and content until they subscribe.

WARRANTY DISCLAIMER: Levelingo LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. The Licensed Application is provided “as-is” without warranties of any kind.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Levelingo LLC's sole responsibility.

4. Maintenance and Support

Levelingo LLC is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law.

You and Levelingo LLC acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

Support is only available via email at support@levelingo.com. Response times are not guaranteed, and delays may occur.

5. Product Claims & Liability

You acknowledge that Levelingo LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to:

• Product liability claims
• Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection, privacy, or similar legislation

This EULA does not limit Levelingo LLC's liability to you beyond what is permitted by applicable law.

6. Content Moderation

We have systems in place to prevent offensive or inappropriate flashcard generation. However, if a user finds ways to generate harmful or rule-breaking content, we reserve the right to ban their account without warning.

7. Third-Party Services & Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application. The app uses the following third-party services:

• Firebase (authentication and database services)
• PostHog (analytics)
• RevenueCat (subscription management)
• OpenAI/ChatGPT (AI content generation)

You must ensure that your use of the Licensed Application does not violate any terms of service for these third-party providers or any other applicable agreements (e.g., if you have limited data plans, you must not violate your wireless data service agreement when using the Licensed Application).

8. Termination

We reserve the right to suspend or permanently terminate any account for any reason, including violations of these Terms. There is no appeals process once an account is banned.

9. Accuracy & Reliability

Levelingo is powered by AI-generated content. While we optimize our systems for quality, we cannot guarantee that lessons are always accurate or appropriate. We make no guarantees regarding language learning outcomes.

The app is provided “as-is.” We do not guarantee uptime, data accuracy, or uninterrupted service.

10. Updates & Changes

We may update these Terms at any time. It is your responsibility to review the Terms periodically. Continued use of the app after updates constitutes acceptance of the new terms.

11. Account Deletion

If you wish to delete your account, please email support@levelingo.com with your request. Account deletion is not yet available in-app.

12. Governing Law & Third-Party Beneficiary

These Terms are governed by the laws of the State of Georgia, United States, except where Apple's jurisdiction applies for App Store-related matters.

You and Levelingo LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
